Retired KGO-TV photographer Doug Laughlin has filed a federal civil rights lawsuit against the Oakland Police Department, accusing several officers of attacking him and breaking his camera as he tried to film outside a hospital on the day four officers were killed.

Laughlin said several officers accosted him on March 21, 2009, outside Highland Hospital in Oakland as he tried to film the arrival of an ambulance carrying one of the mortally wounded officers.

 

The video shows off-duty Officer Fred Shavies running toward Laughlin and yelling, "Hey! Get the f-- out of here!" Shavies then knocked Laughlin against a parked car, breaking the camera's viewfinder, according to the suit filed in U.S. District Court in San Francisco.

A group of officers then forced Laughlin away from the hospital and onto East 31st Street.

"You guys can't do this to me," Laughlin protests on the video.

Police sgt. Rich Vierra, who at the time was chief of staff to then-acting Chief Howard Jordan, tells Laughlin, "Sir, look at what we're doing here, man. Sir, that's one of our police officers that got shot. You need to leave."

Uniformed Officer Luke Sincerny repeatedly tells Laughlin, "Please go," as off-duty officers herd Laughlin along.

Laughlin tells the officers that they can't force him away because it's a public street. Sincerny responds, "It's not important right now," as Vierra tells the cameraman, "It's not. You are interfering with a crime scene. I will place you under arrest."

The camera kept rolling as the officers pushed Laughlin across the street and onto the sidewalk, the suit said. Officer William Pappas tried to tear the battery pack off the camera, and an unidentified sergeant put up yellow police tape to block Laughlin's access, the complaint says.

The suit, which names the city, the Police Department, Shavies, Vierra and Pappas, seeks unspecified damages and a court injunction barring Oakland officers from "interfering with plaintiff's and other television camera persons' and other journalists' rights to engage in journalistic activities."

The suit was filed by San Francisco attorneys Charles Bourdon, Rai Sue Sussman and John Scott. Scott often files lawsuits against the city of Oakland on behalf of officers who believe they were wrongly disciplined.

"The public has a right to be informed and for its journalists to report the news," Bourdon said. "Mr. Laughlin was doing his job to present a newsworthy event to the public and was not at any time interfering with the legitimate actions of the police."

Bourdon said he will seek an unspecified amount of money and an injunction to prevent police from violating journalists' First Amendment rights.
"I think obviously it was a horrible day for everyone," Sussman said. "It was an emotional time. But that is why we have a professional Police Department. We expect that because they have extra responsibilities, they should be able to act professionally in an emotionally charged time."

Officer Jeff Thomason, a police spokesman, said viewers should recognize the context of the video. Officers were dealing with what was the single deadliest day for the department. Sgt. Mark Dunakin and John Hege, both motorcycle officers, were shot and killed by wanted rapist Lovelle Mixon during a traffic stop. Hours later, while holed up in an apartment building, Mixon shot and killed SWAT Sgts. Ervin Romans and Daniel Sakai. Mixon was then shot dead by police and an Alameda County sheriff's deputy.

The officers outside the hospital were trying to come to terms with a horrific loss, Thomason said. Some were concerned that video of the stricken officers could be viewed by family members before they had been notified, police said. "They're human beings," Thomason said.

The city paid several thousand dollars to replace Laughlin's viewfinder, Thomason said. "It doesn't change how they acted," he said. "An incident took place that was unfortunate. We did an internal investigation. Obviously we're not proud of it, but corrective matters were taken."

Lauglin comments about the suit, "Let me just say, I wish I had more photojournalists on scene the day this happened. To see an attack like mine would have enraged any news person. Also, it wouldn't have been bad to have other pictures or video of the assault. Just remember folks, keep an eye (and a lens), out for one another. This could happen to you."

1. Contest is open to any paid member of SFBAPPA. Student and Associate members are also eligible. Entries will be automatically disqualified for non-membership. Membership application: www.sfbappa.org

2. There is no entry fee.

3 Any published or unpublished image will be accepted. See categories below. Pictures may be entered only once, either during the month they were taken or the month they were first published. The only exception to this rule is that pictures included in a picture story may also be entered as single photos as well. Single pictures that are also part of a picture story must be entered in the same month as the picture story that they are a part of. All single picture category entries (i.e., spot news, features, etc) can only include one image.

4. A member may enter up to 12 clips per month. Picture Stories count as one entry and may include a maximum of 12 individual pictures.

5. Entries will be disqualified if name of photographer or affiliation is visible in submitted image.

6. Submit RGB photo files at 72 dpi with a width or height no greater than 10 inches. The JPEG should be saved at "Maximum".

7. You can use any file name, but you must have the .jpg at the end of the file name.

8. In Adobe Photoshop File Info or Photo Mechanic IPTC caption information or Stationary Pad, include: caption (inside Caption or Description field), your name (inside Photographer or Byline or Author or Creator field), affiliation or school (inside Credit field) and E-mail address (inside Special Instructions field). Do not use any other caption plug-ins.

F. Make sure your .zip file is no larger that 19 Megabytes. The server can handle up to 19 megabyte files, but please try to keep file sizes to a minimum.

H. Hit the "Choose File" button under "Upload Files" on this page.

Sports - One photo of sports action or sports feature.
Portrait / Illustration - One photo that is under the control of the photographer or clearly communicates the personality of the subject.
Feature - Events and subjects (other than Spot News, General News, Sports or Portrait/Illustration) depicted in one photo.
Picture Story - A maximum of 12 pictures of a subject or event. Can include photo essays, sequences or series.
Humor - One picture that portrays the lighter side of life.

You are invited to SFBAPPA's PhotoNight on Thursday, Sept. 23 with sports photographers Marcio Sanchez, Ezra Shaw, John Todd and Doug Zimmerman as they show their work and talk about their experiences coverimg the World Cup in South Africa this summer. The is the first SFBAPPA PhotoNight of the fall season.

Marcio Sanchez:
Marcio Sanchez is a staff photographer with the Associated Press in San Francisco and has been with them since 2002. Previously he worked at The Kansas City Star from 1995 to 2002. As a student, he interned at various newspapers including the Long Beach Press-Telegram, Reno Gazette-Journal and Palm Beach Post. Sanchez attended San Jose State University where he received a degree in photojournalism with a minor in Latin American Studies. He was born in San Pedro Sula, Honduras and emigrated to the U.S. with his family at age 12 in 1983. In his 16 years as a photojournalist, Sanchez has covered a diversity of stories. Some of the highlights: Wildlife Preservation in Africa, Hurricane Mitch in Honduras, Baseball in the Dominican Republic, The Super Bowl and Winter Olympics in Vancouver. Sanchez's work has been published in the New York Times, USA Today, Sports Illustrated, Newsweek and National Geographic.

Ezra Shaw:
Ezra Shaw has been working for Getty Images as a staff photographer for over 12 years. He began his career assisting several Sports Illustrated photographers in both London and New York. Shaw spent nearly ten years travelling the world using New York City as his base before moving to Sydney, Australia in 2006 to experience what life "down under" had to offer. After spending almost three years in Australia, Shaw relocated to California and currently lives in Sausalito. "It was the first time I covered it (World Cup Soccer) - so I will speak about my experience being there for the first time, and tie that in to the way that Getty Images covered the event. We had a total of 39 photographers covering the event, which was the most we have had at any single event, including the Olympics."

John Todd:
John Todd has been a professional photographer for over 20 years. After attending St. Lawrence University in upstate New York, he got his start working as a photojournalist for an East Coast newspaper. In 1990, he returned to his native town of Palo Alto to begin his own photography business. He has a wide range of expertise in photography including corporate, sports, fine art, and advertising promotion. Todd is the team photographer for Major League Soccer's San Jose Earthquakes since the team's inception in 1996. He also owns and operates International Sports Images (www.isiphotos.com) the official photography supplier to the U.S. Men and Women's soccer teams, WPS, the University of California Berkeley, Stanford University and the Maverick's Big Wave Surfing contest. He has covered the 2002, 2006 Men's World Cup, 1999, 2003 Women's World Cup, and has traveled with the U.S. Men's team to such places as Cuba, Panama, and the Netherlands. His work has appeared in Time Magazine, USA Today, The New York Times, The Washington Post, Sports Illustrated and ESPN the Magazine, and has been displayed at the Smithsonian Institution as part of a women-in-sports photography exhibit. In addition to his commercial and editorial work, Todd also teaches a yearly sports photography class in the Stanford Continuing Studies program at Stanford University.

Doug Zimmerman
Melding his love of soccer and photography, Doug Zimmerman has traveled to South Korea, Japan, Germany and South Africa for the past three FIFA World Cups. His work has centered on his on-going photography essay about the
soccer fans who travel from all over the world and will give everything to support their nation's team during the World Cup. In between World Cups, Zimmerman held staff photography positions at the San Francisco Business Times
as well as the Los Angeles Times Community Newspapers in Orange County. He has also been a online photo editor for Fortune.com, the New York Times Digital and currently for the SFGate, the website for the San Francisco Chronicle. He has been a freelance photographer based in San Francisco since leaving his staff job at the Los Angeles Times in April 2006.

Looking for photojournalists in both newspaper and television fields who are interested in speaking and mentoring local high school students during a half day journalism "Boot Camp" on , Friday, October 1.

Photojournalists can show their work and talk about their profession. Mentors will also be asked to critique students work on a one-on-one basis.

Last year professionals presented sessions on sports photography, video equipment, live television and multimedia.

The annual Boot Camp is co-sponsored by the San Francisco Peninsula Press Club and the San Francisco Bay Area Press Photographers Association to help all high journalism students.

The awards were presented at the 51st Annual Awards Banquet on Sunday, April 11, at Scott’s Restaurant in Oakland. About 100 news photographers as well as photojournalism students in the greater San Francisco Bay Area and Sacramento areas from every major newspaper, wire service and television station entered their work from 2009.

San Jose Mercury News staff photographer LiPo Ching scored an Emmy nomination for his video, "Disabled In Vietnam". The awards ceremony is at the Lincoln Center in New York City on September 27.

Ching's video on the Mercury News website was nominated along with the websites of the New York Times, Los Angeles Times, Boston Globe, Time, Reuters and Canada's Globe and Mail.

"I'm excited about receiving the nomination — it's great that newspapers have this new multimedia avenue for storytelling," he said, "and I'm really happy that this story resonates with San Jose's Vietnamese community."

His video, "Disabled In Vietnam," was nominated in the category of "New Approaches to News & Documentary Programing: Current News Coverage," for the the National Academy of Television Arts & Sciences.

"I'm really proud of LiPo because this nomination is a complete validation of why we hired him. The Emmy nomination — a feat in and of itself — confirms the talents we saw he possessed. He's not only an excellent journalist, but he's selfless with respect to sharing his knowledge with his co-workers to help them produce their best work, too," said Michael Malone, director of photography at the Mercury News.

This is the third time the Mercury News has been nominated for an Emmy in the last three years, winning once. Staff Photographer Dai Sugano won an Emmy Award in 2008 for his video of mobile-home residents in Sunnyvale, beating out competitors from PBS and the websites of the New York Times and Los Angeles Times. Sugano was also nominated for another piece he did in 2008.

Ching joined the Mercury News as an intern in 2006 while working toward his master's degree in photojournalism/journalism at the University of Missouri. He joined the staff full-time upon the completion of his internship. Previously, he had worked for 13 years as a freelance producer in the film and television industry in Los Angeles. He completed a short film under the auspices of a National Endowment Advertisement for the Arts Grant in 1998.

The Oakland school district has agreed to pay $99,000 to settle a lawsuit filed by Oakland Tribune photographer Jane Tyska over a confrontation with its former police chief during an October 2008 protest.

Tyska commented, "I'm very happy that the Oakland school district has taken responsibility for the actions of its former police chief. "... If it wasn't for the video I shot, this abuse of power would never have come to light. It's now illegal in a dozen states to record police activity, and this case is an excellent example of why that right needs to be protected. One of the reasons people often fear cameras is because they tell the truth."

Tyska, was covering an immigration march in East Oakland's Fruitvale neighborhood when she was grazed by a squad car driven by Art Michel, the school district's former police chief.

Michel accused Tyska of intentionally swinging her elbow into his car, blocking the street, and trying to incite a riot among the mostly teenage protesters. Tyska's camera was rolling during part of the heated exchange, in which the police chief called her a "lying (expletive)." Michel detained Tyska and confiscated the videotape, but it was later returned to the Tribune. The District Attorney's Office declined to file charges against the journalist. Two months later, Michel resigned.

In December, Tyska filed suit against Michel and the school district, accusing the officer of violating civil rights laws, as well as of assault and battery. Representatives from the Oakland school district settled the case through mediation, said Tyska's attorney, Terry Gross, of Gross Belsky Alonso. Michel wasn't required to participate in the process, Gross said.

Troy Flint, a spokesman for the Oakland school district, said he hadn't heard about the settlement. But, he added, "obviously, the conduct in this incident was not the type we condone, and we're happy to put this behind us."

She said half of the settlement will go for attorney fees.

 

Award-winning television photographer Rich Carlson died on Sunday, July 11. Carlson, 62, is a retired KRON-TV photographer and lived in Santa Cruz. He was named SFBAPPA's Television Photographer of the Year and runner up for the National Press Photographers Association's Television Photographer of the Year.

Carlson started at KRON in February 1977. At KRON, he traveled to the Soviet Union. He also did a story on Lady Diana in England. One of his favorite assignments was covering the America's Cup. Ten years ago, Carlson took early retirement to care for his mother. After his mother died, he started doing travel journalism, including shooting for Talkintravel TV show and shooting still photography. He loved to sail and bike.

Carlson grew up in San Leandro and graduated from San Francisco State University. He started in journalism as a messenger for KTVU.

He is survived by his wife, Ruth; brother Bob; and 17 nieces and nephews.

A celebration of life gathering is planned around his birthday on September 23 in Santa Cruz.
